A life estate is the right to the use and possession of property for the duration of the life tenants life. It is not a lease.

Property that is encumbered by a life estate cannot be sold or mortgaged without the consent, in writing, of the life tenant. A life estate is an encumbrance on the property that can only be released by the life tenant or by the life tenant's death. The life tenant can release the life estate in writing, acknowledged and the release must be recorded in the land records.
